ORDINANCE NO. 745 

AN ORDINANCE TO OFFICIALLY VACATION A PORTION OF A PUBLIC ROAD RIGHT-OF-WAY
LOCATED IN SECTION 30, T2S, R6E, SLB&M

WHEREAS, Raymond Alt and Patricia Standing petitioned Summit County to vacate that portion of an Old State Road and/or Old County Road right-of-way, which traverses a parcel owned by the petitioners having parcel numbers CD2061 and CD-2061-A and which is described in Exhibit A; and

WHEREAS, Utah Code. Section 72-3-108 provides mechanisms to vacate county roadways; and

WHEREAS, a public hearing has been held with the Summit County Council on August 4, 2010, with notice provided as required in Utah Code, Section 72-3-108(2) by advertising the proposed vacation in the Summit News on July 2, 9, 16, 23 and 30, 2010; and

WHEREAS, there is good cause to vacate this portion of a public
road based on the findings of the County Council that, 1) the road does not, nor will it access any public lands, public uses or provide any other public purpose; 2) the road is not included on the County's Class D or B road maps; and 3)  the road the is not the only means of access for any property owner along the road; and

WHEREAS, the vacation will not be detrimental to the general
interests of the community nor materially affect the access enjoyed by the general public or other property owners in the area;

NOW THEREFORE, the County Legislative Body of the County of
Summit, State of Utah [hereinafter "Council"], ordains as follows:

Section 1.  The Council hereby finds that the road vacation will not be detrimental to the general interests of the community nor will the access enjoyed by the general public or other property owners be materially changed.

Section 2.  The Council hereby officially vacates the public road right of way, as specifically described above as of the effective date of this ordinance.

Section 3.  This Ordinance shall take effect after 15 days of the date below, and upon publication in a newspaper published and having general circulation in Summit County.

The Snyderville Basin Special Recreation District is seeking the services of an experienced, qualified design-build contractor to perform the following services:

Design/Build and Construction Management
Mezzanine Storage Space
Trailside Park, Park City, UT

Sealed proposals for the work described will be received at the Snyderville Basin Special Recreation District Office 5715 Trailside Drive Park City, Utah until 3:00 pm, Wednesday, September 15, 2010.  Proposals are to be addressed to the attention of Bruce Dickens, and endorsed "Trailside Mezzanine" 

If you are interested in submitting a Proposal, information on the Request for Proposal and Guidelines for Preparing a Proposal will be available August 25, 2010 and can be obtained from Snyderville Basin Special Recreation District by calling (435) 649-1564 x-14. The successful party shall be expected to verify they have structural engineer services available to assist in calculating loads in the proposed design. 
 
A mandatory pre-bid meeting will be held on site at the Snyderville Basin Special Recreation District Office, 5715 Trailside Drive, Park City at 1:00 pm on Tuesday, September 7, 2010. Failure to attend the mandatory pre-bid meeting disqualifies a contractor from submitting a proposal on this project.  

The Snyderville Basin Special Recreation District specifically reserves the right to reject any proposals or to waive formalities or technicality in any proposal in the interest of the District, including but not limited to, the low bid proposal if the District determines that the low bid is not a responsive or responsible bid.  No bidder may withdraw the submitted proposal for a period of thirty (30) days after the date of opening thereof.

Selection shall be based on an evaluation of the criteria set forth in the RFP, including design/build construction and construction management experience, technical competence, capability to perform the work, and past experience in design-build and construction management.
